New York personal injury lawyer David Perecman comments on the New York elevator accident that killed an advertising executive in a midtown office building. The accident was likely caused by a gross malfunction.
NEW YORK, NY, December 24, 2011 /Real Estate PR News/ -- An advertising executive was crushed to death by an elevator last week.
Suzanne Hart, 41, was crossing into an elevator in a midtown office building when the cab suddenly shot upward while the doors were still open, reported the New York Post (12/15/2011).
"There is no question that the elevator severely malfunctioned. A safety mechanism called an interlock should have prevented the elevator from moving while its doors were open," said New York personal injury lawyer David Perecman, a personal injury lawyer for over 30 years.
When the elevator jerked up, Hart fell halfway into the car, said the New York Post. The elevator then ascended to the second floor with its doors still open.
Hart was dragged into the elevator shaft, where she became wedged between the elevator and the shaft wall, reported the New York Daily News. (12/14/2011)
The elevator stopped between the building's first and second floors. Two people aboard the elevator were forced to look on as Hart died.
Though they were not physically hurt in the New York elevator accident, both witnesses were hospitalized for treatment of psychological trauma, reported the New York Post.
Electrical work is now the focus of the fatal elevator accident investigation.
"If an elevator malfunctions and causes serious elevator accident injuries or a death, the building owner, building management company, and elevator maintenance company may be held responsible," explained New York personal injury lawyer Perecman, founder of The Perecman Firm, one of New York's personal injury law firms.
